Delegated Authority - Contract Signing.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the delegation of authority to the Chief Officer, Director of Municipal Services, Director of Waste Management, Director of Waste Strategy and Special Projects, Director of Transport and the Finance Director to sign formal contracts up to their pre-agreed financial authorisation limits.

Reason(s) for Decision: To enable Officers to enter into formal engineering contracts for minor works.

TRANSPORT AND TECHNICAL SERVICES

DELEGATED AUTHORITY – CONTRACT SIGNING

Purpose of the Report

To seek delegated approval from the Minister – Transport and Technical Services for the Chief Officer and Directors to sign formal contracts on behalf of the Minister.

Discussion

Under the old Committee system when a formal engineering contracts or formal engagement of consultants was awarded, the Greffier of the States had to sign each contract as that post represented the States of Jersey. Under the old States of Jersey Law the body corporate was the States. However, when the new system of ministerial government commenced, it is the Minister who is now the legal entity.

The Department awards many formal engineering contracts and forms of engagement using the relevant professional institution’s standard conditions e.g., ICE, NEC, MF1, ICHEME, etc. For contracts to be valid in the event of any formal challenge, the signature from the client’s side must be duly authorised. It is proposed that the current level of Officer financial delegation be extended to cover formal contract signing. The only Officers permitted to sign a contract on behalf of the Minister will be the Chief Officer, Director – Municipal Services, Director of Waste Management, Director of Waste Strategy and Special Projects, Director of Transport and the Finance Director.

As part of the Departmental quarterly reporting mechanism, the Minister will receive a report showing the number of contracts, their form and contract value.

Recommendation

The Minister is recommended to approve the delegation for contract signing to the Chief Officer and Directors up to their already allocated financial authorisations.

Reason(s) for Decision

To enable the Department to use formal engineering contracts for minor works up to the financial delegation given to Senior Officers.
