Diseases of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007: Proposed Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Assistant Minister agreed that the Diseases of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007 should be amended to recognise official eartags from outside the Island identifying imported animals and to approve identification by microchip for zoo animals imported and kept at Durrell.  

Reason(s) for Decision:

Animals imported into Jersey have to be re-identified with local official eartags on arrival.  Amendment will remove this requirement.

States Veterinary Officer to request that the Law Draftsman prepare a revised draft Order on the basis of a drafting brief to be supplied by the Department and for subsequent consideration by the Minister.

Purpose of the Report

Amend the Disease of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007 to enable recognition of official eartags of the exporting country, identifying imported sheep, pigs and goats and in the case of Durrell Wildlife Conservation Trust recognise microchip identification for the species.

 

Background

The Disease of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007 requires all pigs, goats and sheep in Jersey to be officially identified but does not enable the use of microchips. Imported animals have to be re-tagged to comply with the Order, including animals at the Durrell Wildlife Conservation Trust (DWCT). Zoos and similar organisations in the EU are able to identify animals with microchips.

 

Discussion

 

It is proposed to allow official eartags of the exporting country to be recognised for identifying animals imported into Jersey and to enable official recognition by microchip of animals imported to or born at DWCT.

Each animal will still have a unique identification number to allow tracing in case of an outbreak of a notifiable disease and for traceability if entering the food chain.

 

Conclusion

Legal provision to implement these important disease control measures strengthen Jersey’s objective of maintaining high health status whilst ensuring that the level of control is proportionate to risk.

 

Recommendation

 

The Minister is recommended to make an Order to amend Disease of Animals (Pigs, Goats and Sheep Registration, Identification and Movement) (Jersey) Order 2007 to recognise official eartags and microchips identifying imported animals and to enable DWCT to identify animals using microchip.
