Budget transfer of ESC Estates Management Services to Property Holdings.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Transfer of ESC Estates Management Services to Property Holdings Department

Decision(s):

To approve the following transfers from the Education, Sport and Culture Department to the Property Holdings Division of the Treasury and Resources Department:

a. 9.54FTE staffing with effect from 1 October 2006.

b. A revenue budget of £3,769,395 for 2006 and £3,761,333 for 2007 together with total expenditure incurred in 2006 to date and open orders.

c. Capital projects budgets as shown at Appendix A of the report in the sum of £35,063,641 (£35,273,641 less the projected savings of £150,000 on d’Auvergne and of £60,000 on Langford, which it has been agreed with the Treasury and Resources Department can be applied to ICT funding in 2007).

This decision revokes the previous decision on the 4th December 2006 relating to the financial and manpower transfer.

Reason(s) for decision:

In June 2005, the States approved the creation of the Property Holdings to be responsible for the administration of all States property.

The above transfer is a necessary stage in the creation of this new organisation.

In October 2006, The Treasury and Resources Minister approved the transfer of budgets between Education, Sport and Culture and Treasury and Resources Departments.

This proposal has no additional financial or manpower implications on the States.

  1. To transfer the identified budgets and balances to Property Holdings.
