States of Jersey (Amendment No. 8) Law 201- (P.33/2014)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Lodging of States of Jersey (Amendment No.8) Law 201-

Decision(s):  The Chief Minister decided to lodge ‘au Greffe’ the States of Jersey (Amendment No.8) Law 201- for debate by the States at the earliest opportunity.

Reason(s) for Decision:

The States of Jersey (Amendment No. 8) Law 201- is the result of an extensive two-year consultation process.  It seeks to amend Jersey’s machinery of government in order to improve its function.  The draft Law is intended to implement those recommendations of the Machinery of Government Review Sub-Committee that gained broad support through the consultation process.  It would introduce collective responsibility for the Council of Ministers and enable the States Assembly to make subsequent decisions regarding arrangements for Scrutiny through Standing Orders. 

The members of the Machinery of Government Steering Group met with the Privileges and Procedures Committee on 6 March 2014 to discuss the lodging of the draft Law.  The Committee did not find a majority in favour of lodging all of the proposed amendments in the name of the Committee.  The Chief Minister therefore offered to lodge the draft Law if this was felt to be helpful, and it was concluded that this would be the best way in which to ensure that the States Assembly had an opportunity to express a view on the proposed amendments.  The Council of Ministers considered this matter on 12 March 2014 and a majority supported that the draft Law should proceed to lodging ‘au Greffe’ by the Chief Minister in order to ensure that the States Assembly could decide upon the recommendations.

Resource Implications: There are no financial or manpower implications.

Action required: The Greffier of the States is requested to lodge ‘au Greffe’ the States of Jersey (Amendment No.8) Law 201- for debate by the States at the earliest opportunity.
