Liquor Licensing (Jersey) Law 201-: Re-Lodging

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Draft Liquor Licensing (Jersey) Law 201-: re-lodging

 

Decision(s):

The Assistant Minister, with reference to Ministerial Decision MD-E-2017-0020, resolved to –

(a)   withdraw the draft Liquor Licensing (Jersey) Law 201- (P.54/2017 refers) and

(b)   re-lodge the draft Law with a revised accompanying report explaining the rationale for re-lodging and with a view to securing a States debate in January 2018.

Reason(s) for Decision:

P.54/2017 was lodged on 7th June 2017, having been endorsed by both the Shadow Alcohol Licensing Policy Group and the Council of Ministers. The draft Law would be timed out unless debated by the end of November 2017. 

 

The Economic Affairs Scrutiny Panel advised the Assistant Minister that it could not complete its review of the draft Law and report to the States in time to facilitate a States debate by the end of November.  Having reflected on the position and having consulted the Shadow Alcohol Licensing Policy Group, the Assistant Minister wished to give the Scrutiny Panel a reasonable amount of additional time to complete its work and report to the States Assembly.

 

The Minister was content that Connétable S.W. Pallett of St. Brelade retained delegated authority as the Assistant Minister with responsibility for liquor licensing policy and legislative development in accordance with the terms of R.12/2015.

Resource Implications:

Resource implications are set out in the report accompanying the proposition. 

 

The new Law will in due course require £100,000 per annum ongoing funding (inclusive of funding for up to 1 FTE) plus up to £100,000 one-off set-up costs from the restructuring provision to support implementation of a new online administration system. Efforts will be made to reuse systems already being procured or in development in other departments, so as to minimise the funding required from the restructuring provision.

 

 

 

The intention is for the above costs to be borne by industry through the setting of a revised fee structure, the nature of which will be set out in draft Regulations. 

Action required:

Report and proposition to be forwarded directly to the States Greffe. The Greffier of the States is requested to arrange for the proposition to be lodged ‘au Greffe’ as per the decision above.
