Amendments to Road Traffic (St. Brelade) (Jersey) Order 1990.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Assistant Minister agreed to the following amendments:

     1. Include in the Order the currently unscheduled prohibition of waiting lines marked in Le

         Clos des Sables.

    2. Prohibit waiting on both sides of a section of La Route Orange, and a section of Le Chemin

         de Maudelaine.

     3. Change the times of loading and unloading at the unloading bay at Charing Cross, St Aubin.

     4. Make Le Mont des Longchamps, between Le Mont Les Vaux and Le Mont Nicolle subject to

         a 12 hours in any continuous period of 24 hours waiting restriction.

     5. Extend the current prohibition of waiting on the east side of La Neuve Route near to the                 

        Sacred Heart Catholic Church.

     6. Make both sides of La Rue du Cimetiere subject to prohibition of waiting.           

Reason(s) for Decision: At the request of the Connétable, to amend the Road Traffic (St Brelade) (Jersey) Order 1990 to improve traffic management at the above locations in the Parish of St Brelade

Resource Implications: Law drafting time.

Action required: The Assistant Minister to request officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 – AMENDMENTS  
 

Purpose of the report  

To improve the traffic management in the Parish of St Brelade. 
 

Background  

The Connétable of St Brelade has written to the Department requesting the Assistant Minister for Transport and Technical Services to amend the above Order as follows:- 

  1. Include in the Order currently unscheduled prohibition of waiting lines marked in Le Clos des Sables.

 

  1. Prohibit waiting on both sides of a section of La Route Orange in the vicinity of La Moye School, and both sides on a section of Le Chemin de Maudelaine.

 

  1. Change the times of loading and unloading at the unloading bay at Charing Cross, St Aubin, from the current one hour time limit between the hours of 10.00am and 6.00pm on any day other than Sunday, to a one hour time limit between the hours of 7am and 10.30pm every day inclusive of Sundays and bank holidays.

 

      4. Make Le Mont des Longchamps, between Le Mont Les Vaux and Le Mont Nicolle, subject to a 12 hours in any continuous period of 24 hours waiting restriction. 

  1. Extend the current prohibition of waiting on the east side of La Neuve Route near to the Sacred Heart Catholic Church.

 

      6. Make both sides of La Rue du Cimetiere subject to prohibition of  waiting.

 

Discussion 

  1. The request with regard to Le Clos des Sables is considered necessary as the Parish have noted that two of the prohibition of waiting lines currently present in Le Clos des Sables are not contained in the Road Traffic (St Brelade) (Jersey) Order 1990. 

 

  1. The request to prohibit waiting on both sides of La Route Orange and a section of Le Chemin de Maudelaine, in the vicinity of La Moye School, is requested as a car park has now been provided for the use of the parents of pupils of the School.  The Parish are mindful of the danger to pupils crossing La Route Orange and the traffic congestion caused by vehicles parking on this section of the road during school periods.

                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                        

  1. The request to extend the loading and unloading times of the unloading bay at Charing Cross, St Aubin is due to a request from the owners of the “New Dynasty Restaurant and Take Away” who wish to use the unloading bay for their “take away” operation. The company’s three drivers currently park at a nearby vacant property which will shortly become unavailable for their use. The request has the support of the Parish Roads Committee.

 

  1. The request with regard to Le Mont des Longchamps is considered necessary due to large vehicles parking for several days on this currently unrestricted stretch of road, and thereby causing congestion at peak times.

 

  1. The request to extend the current prohibition of waiting on La Neuve Route near to the Sacred Heart Catholic Church, is to allow additional space for vehicles to overtake between the two existing sections of prohibition of waiting on the west and east sides

 

  1. The request to make La Rue du Cimetiere subject to prohibition of waiting is due to the hazard caused by vehicles persistently parking near the corner of this narrow road. 

Recommendation

 

The Assistant Minister is requested to approve the requests.

The Assistant Minister to request officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
