Highlands College, Turner Building Phase 2: Approval of drawings for roof refurbishment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Turner Building Phase 2 - Approval of Drawings for Roof Refurbishment.

Decision(s):

 

In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister,  

under delegated authority:

 

  1. approved Permit P/2008/1571 and drawings numbered: 139-01b, 02b, 03a, 04, 05, 06, 07, 08, and 11549-01 - all showing the proposed second phase of works to the Turner Building Roof Refurbishment.

 

  1. accepted the lowest tender of Larsen Ltd. in the sum of £ 697,116.39

 

Reason(s) for Decision:

The scheme was approved by the States in successive Resource Plans in 2004 and 2005.

Funds allocated for the refurbishment of the Turner Building were prioritised to the works included in Phase 1. The successful completion of these works in August 2009 within the available budget has provided a residual funding stream to undertake the most urgent of the remaining works as Phase 2 of the project; namely the roof.

The drawings noted in item (a) above and which the Heritage Officer has also approved reflect the use for which the funding was originally provided.

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

The estimated total cost for the works to the Turner Building Roof (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the remaining budget.

 

The lowest fixed price tender submitted by Larsen Ltd. in the sum of £697,116.39 can be accepted and a contract entered into.  This is the recommendation made by Quantity Surveyors Woodward Burton Associates in their report dated 4 March 2011.

Resource Implications:

None. There are no further financial or manpower implications.  The current approved and remaining budget is sufficient to carry out the works as planned.

Action required:

 

1) Note the approval of the Phase 2 alterations of the Turner Building under Standing Order 168 (1) (d)

2) The Accounting Officer JPH to arrange for the contract and any other associated documentation to be signed.
