1 - 2 Villa Nuova, La Route de la Haule, St. Brelade: Listing

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to:

  1. List 1-2 Villa Nuova; and
  2. assign a non-statutory grade 4 to it

Reason(s) for decision:

  1. Notwithstanding the representations received on behalf of the owner of the building, which were duly taken into account and considered by the Minister where they were of relevance to an assessment of the building’s heritage interest, the special interest of 1-2 Villa Nuova La Route de la Haule relative to the published criteria for selection, justifies its Listing in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002. The Minister considered that these buildings were of special interest, being good examples of seaside buildings of this period; which contributed to the historical and architectural character of the area along with other neighbouring buildings of a similar period of the Island’s development;
  2. The Minister was of the view, having considered the evidence before him, including photographs of the interior of the properties, that there was insufficient survival of original interior features to warrant protection of their interiors.

Legal and resource implications:

  1. Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 requires the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.
  2. Article 52(3) enables those with an interest in the building or place upon whom the Minister serves notice to make written representations to the Minister and Art 52(4)(a) requires the Minister to take these into account in determining the status of the building.
  3. The law does not explicitly provide for the Minister to have regard to any representations made by other parties, expect where the Minister actively seeks to consult those with special knowledge or interest in the building. The Minister accordingly noted and acknowledged the desire of residents of neighbouring properties to address him in relation to the proposal to List the building but confined his consideration to the material considerations presented in the form of the representations of the owner and the advice of Jersey Heritage, relative to the special interest of the site.

  1. Serve Notice of the decision to List on the owner and occupier as appropriate
  2. Update the List
