Drafting the Conservation of Wildlife (Amendment No. 5) (Jersey) Order 2009.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Drafting the Conservation of Wildlife (Amendment No.5) (Jersey) Order 2009

Decision(s):

The Minister for Planning and Environment authorised the drafting of the Conservation of Wildlife (Amendment No.5) (Jersey) Order 2009 to change the status of the Starling (Sturnus vulgaris) for the purposes of the Conservation of Wildlife (Jersey) Law 2000 from ‘wild bird’ to ‘protected wild bird’. The Order will come into force seven days after it has been made.

Reason(s) for Decision:

The proposal accords with the States Strategic Plan of implementing the Biodiversity Strategy. Since the introduction of the Conservation of Wildlife (Jersey) Law 2000 a long term decline in the species has been documented both locally and nationally. The species has been added to the list of birds of High Conservation Concern in the United Kingdom.

Purpose of the Report  

The purpose of this report is to request that the Minister authorise the drafting of the Conservation of Wildlife (Amendment No.5) (Jersey) Order 2009.  

Background and discussion  

Under Article 2 (2) of the Conservation of Wildlife (Jersey) Law 2000 all birds are protected unless they are specifically identified as not being protected in Schedule 1 Part 2 of the Law.

The Common starling (Sturnus vulgaris) is currently not protected under the Law. 

Long-term monitoring in the United Kingdom has indicated that starling numbers have been in decline since the 1960s. The species has recently been added to the list of birds of high conservation concern in the United Kingdom.  

A decline in the population of the Common starling has also been noted in Jersey. The proposed Conservation of Wildlife (Amendment No.5) (Jersey) Order 2009 would change the status of the species for the purposes of the Law from ‘wild bird’ to ‘protected wild bird’.

Recommendation 

That the Minister instructs the Director of Environment to request that the Law Draftsman prepare Conservation of Wildlife (Amendment No.5) (Jersey) Order 2009 for subsequent approval by the Minister so that the Order may be brought into force.
