Budget transfer from Education to Community and Constitutional Affairs: Independent Jersey Care Inquiry

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The non-recurring transfer of £50,000 in 2016 from the Education revenue head of expenditure to the Community and Constitutional Affairs (CCA) revenue head of expenditure to support the Independent Jersey Care Inquiry (IJCI)

Decision(s): The Minister agreed to request the Minister for Treasury and Resources to approve a non-recurring transfer of £50,000 in 2016 from the Education revenue head of expenditure to the CCA revenue head of expenditure for funding to support the Independent Jersey Care Inquiry (IJCI).

Reason(s) for Decision:

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

This funding was previously allocated from Contingency to the Education Department for work to support the IJCI. This funding is no longer required by Education so is being transferred to CCA where there is a need for funding to support the Inquiry. This transfer does not increase the total cost of the Inquiry.

Resource Implications: The Education revenue head of expenditure to decrease by £50,000 in 2016 and the Community and Constitutional Affairs revenue head of expenditure to increase by an identical amount.

 

Action required:

The Community and Constitutional Affairs Finance Director to request the approval of the Minister for Treasury and Resources for this budget transfer.
