Community Provisions (Restrictive Measures - Iran) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Community Provisions (Restrictive Measures – Iran) (Jersey) Order 2012

Decision(s):  The Chief Minister, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996 and having regard to Council Regulation (EU) No. 359/2011 concerning against certain persons, entities and bodies in view of the situation in Iran, and Council Regulation (EU) No. 267/2012 concerning restrictive measures against Iran and repealing Regulation (EU) No. 961/2010, decided to make the Community Provisions (Restrictive Measures – Iran) (Jersey) Order 2012.

Reason(s) for Decision:  The United Nations Security Council Council has adopted certain measures relating to the Islamic Republic of Iran. These measures include but are not limited to:

  • a proliferation-sensitive nuclear and ballistic missile programmes-related embargo;
  • a ban on the export/procurement of any arms and related materiel from Iran and a ban on the supply of the seven categories, as specified, of conventional weapons and related materiel to Iran;
  • a travel ban and an assets freeze on designated persons and entities.  The assets freeze also applies to any individuals or entities acting on behalf of, or at the direction of, the designated persons and entities, and to entities owned or controlled by them.  

Furthermore, the European Union has introduced -

  • Council Regulation (EU) No. 359/2011 concerning against certain persons, entities and bodies in view of the gravity of the human rights situation in Iran, and
  • Council Regulation (EU) No. 267/2012 concerning restrictive measures against Iran with regard to Iran's proliferation sensitive nuclear activities and the development of nuclear weapon delivery systems.

The current Order, in accordance with Jersey’s policy to implement equivalent sanctions measures, would replace the Community Provisions (Restrictive Measures – Iran) (Jersey) Order 2010, which gave effect in Jersey to Council Regulation (EU) No 961/2010 concerning restrictive measures against Iran and, in its place, give effect to Council Regulation (EU) No. 267/2012.

This Order would also replace the Community Provisions (Restrictive Measures – Iran) (No. 2) (Jersey) Order 2011 which gave effect in Jersey to Council Regulation (EU) No. 359/2011, and would  update the effect in Jersey of Council Regulation (EU) No. 359/2011 as amended up to 24th March 2012, together with the introduction of additional restrictive measures including:

  • restrictions on equipment which may be used for internal repression;
  • a prohibition on the export of telecommunication equipment for use by the Iranian regime.

Resource Implications: There are no manpower or revenue implications arising.

Action required:  The Chief Minister should sign and seal the attached Community Provisions (Restrictive Measures – Iran) (Jersey) Order 2012. 

The Chief Minister’s Department shall –

(1) inform the Assistant Greffier of the States and the States Greffe Publications Editor immediately the Order is made.

(2) deliver the signed and sealed order to the Publications Editor.
