Air Navigation (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Draft Air Navigation (Jersey) Law 201 -

Decision(s): The Minister for External Relations decided to lodge ‘au Greffe’ the draft Air Navigation (Jersey) Law 201 – for debate in the States Assembly at the same time as the implementing legislation to establish a Jersey Aircraft Registry.

Reason(s) for Decision: The introduction of an aircraft registry in Jersey required significant amendments to the existing provisions under the Air Navigation (Jersey) Order 2008.  Accordingly, in addition to the new provisions the opportunity was taken to update the legislation to bring it into line with current international civil aviation standards.

 

The Privy Council will be asked to revoke the Air Navigation (Jersey) Order 2008 on the same date as the draft Air Navigation (Jersey) Law 201 –, is brought into force by an Appointed Day Act.

Resource Implications: There are no manpower or revenue implications arising directly from the draft Law.  The draft Law however is part of a bundle of aviation legislation to be approved by the States Assembly for the establishment and delivery of the Jersey Aircraft Registry.  The draft Aircraft Registration (Jersey) Law, 201 –, identifies certain resource implications generally.

 

The additional functions assigned to the Director of Civil Aviation (Channel Islands) by the draft Law will be undertaken by the Office of the DCA at no additional cost.

Action required: The Chief Minister’s Department shall:

 

  1. Forward the signed Ministerial Decision, together with the draft Law, and the attached report and signed declaration of compatibility with the ECHR to the Greffier of the States, to be lodged ‘au Greffe’ for debate by the States Assembly before the end of the present Session;

 

  1. The External Relations Department to advise the Economic Development Department of the Minister’s decision accordingly.
