Children's Policy Group and Jersey Child Protection Committee: Budget Transfer to Chief Minister's Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transfer from the Health and Social Services Department (HSSD) 2013 – 2015 budget to Chief Minister Department (CMD) monies and FTE associated with the Children’s Policy Group (CPG) and Jersey Child Protection Committee (JCPC)

Decision(s): The HSSD Minister, in accordance with a decision taken by the Council of Ministers on 4 October 2012, has decided to transfer from HSSD to CMD the monies and FTE associated with the CPG and the JCPC.

Reason(s) for Decision:

To establish a Vulnerable Adults Policy Group and Jersey Vulnerable Adults Protection Committee to provide political co-ordination across Departments in relation to policies that effect vulnerable adults, and to co-ordinate safeguarding activities in order to ensure that vulnerable adults are afforded sufficient protection. In addition, and by association, to transfer responsibility for leading the CPG and the JCPC to CMD. This includes the budget and FTE for the Executive Officer for CPG and JCPC staff being transferred from HSSD to CMD. Note; although responsibility for the CPG and JCPC and budget and FTE are to be transferred to CMD, the HSSD Minister will remain as the Chair of CPG meetings until the point at which the Vulnerable Adults functions are fully established.

Resource Implications: HSSD revenue head of expenditure will decrease recurrently by £274,680 per year (£824,040 over 2013-2015 MFTP period). The CMD revenue head of expenditure will increase by the same amount. This represents £233,780 for JCPC costs plus £40,900 for CPG Executive Officer.

 

The HSSD FTE allocation will decrease by 3.45 FTE. The CMD FTE allocation will increase by the same amount. This represents 0.45 FTE for CPG executive officer; 3 FTE for JCPC staff.

 

Action required:

  1. Treasury & Resources seek the approval of the Minister for Treasury & Resources to accept the budget transfer.
  2. Treasury & Resources to transfer monies from HSSD revenue head of expenditure to CMD head of expenditure.
