A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

Given the minor nature, small size and location within the existing compound, and the extent of control under other legislation, it is considered that it is unlikely that this proposal will have a significant effect on the environment, either of Jersey or elsewhere. The Minister therefore decided that an EIA is not required to support the application to construct a new LPG/Air gas production plant.

Comments on Case

The proposal at the Jersey Gas La Collette site includes various minor equipment, new plant, pipework and storage sheds to enable Jersey Gas to operate solely from La Collette in order to de-commission the site at Tunnell Street. The works are contained within the existing Jersey Gas compound at La Collette are in comparison to the storage tanks and other works at the site, the proposal is minor in nature. However, as the proposal involves an industrial installation to carry gas, the proposal requires an Environmental Impact Assessment under Schedule 1 3(a) of the Planning and Building (Environmental Impact) (Jersey) Order 2006.

 

Under Article 2(4) of the Order, an EIA is not required if the Minister is satisfied that by virtue of factors such as the nature, size or location of the proposed development, it would be unlikely, if carried out, to have a significant effect on the environment, either of Jersey or elsewhere.

 

In order to advise the Minister if the works would be unlikely to have a significant effect on the environment, we have consulted with other States Departments. The consultations included the Health and Safety Inspectorate, Environmental Health, Environmental Protection, Natural Environment Section and Waste Regulation. All consultees are satisfied that the proposed works are of such a minor nature that an EIA is not merited in this instance. Their comments are that the requirements under other legislation for this type of work would be sufficient to ensure that the proposal does not have a significant effect on the environment.

 

Given the minor nature, small size and location within the existing compound, and the extent of control under other legislation, it is considered that it is unlikely that this proposal will have a significant effect on the environment, either of Jersey or elsewhere.
