Civil Aviation: Appointment of Director

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Appointment of the Director of Civil Aviation for Jersey

Decision(s):

The Minister for External Relations, in pursuance of Article 3 of the Civil Aviation (Jersey) Law 2008, and after seeking and receiving the advice of the States Employment Board, appointed Dominic Lazarus as Director of Civil Aviation (DCA) for Jersey.

Reason(s) for Decision:

  • The current DCA has taken up a new post and must be replaced. 
  • The post-holder is the DCA for Jersey and the DCA for Guernsey, enabling significant cost saving and consistent policy implementation across the Channel Islands. It proposed that this joint approach continue.
  • The States of Guernsey, in a joint recruitment process with Jersey, have employed Dominic Lazarus as DCA for Guernsey for an initial period of 5 years. 
  • The States Employment Board has advised the Minister for External Relations on the appointment of Dominic Lazarus as DCA for Jersey.
  • The provision of DCA services to Jersey is governed by a Contract for Services between the Ministry of External Relations and the States of Guernsey. All costs of the Office of the DCA, including salaries, are shared equally between Jersey and Guernsey.

Resource Implications:  A joint appointment of DCA for Jersey and Guernsey enables a 50% cost sharing of salary and associated costs between the Bailiwicks.  The financial costs of the DCA are included as part of the aerodrome licence fee for Jersey airport, which is paid by the Ports of Jersey.

 

There are manpower requirements arising from this contract for services.
