Application to the Population Office for a 'J' Category Licence

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Economic Development endorses the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1979, Regulation 1(1((j) for the post of Business Development Director on the basis of a “J” category housing licence.

Reason(s) for decision:

· The role of Business Development Director is critical to the business of Jersey Harbours and the attainment of the Ports and States Strategic objectives, and is therefore deemed to be ‘essential’ as defined under the housing regulations.

· A local recruitment will be undertaken in conjunction with a UK campaign, the aim to recruit locally. However, it is considered unlikely that this process will identify a suitably qualified and experienced locally qualified candidate.

In view of the need to deliver key operational objectives during 2007 and the high level of professional qualifications and competencies required to fulfil this new post, it would be expedient for the Department to be able to advertise and potentially recruit to this post from outside of the Island in conjunction with the local recruitment process demonstrating economy of effort.

Resource implications:

Financial: £20k for recruitment/interview and completion of campaign provided through consultancy.

Manpower: HR management of recruitment campaign

There are no Property, ICT or Law Drafting implications.

· The Chief Executive Officer makes an application to the Population Office for a "J" category housing Licence to be granted for the post of Business Development Director, under the auspices of the Housing (General Provisions) (Jersey) Regulations 1970, Regulation 1(1)j.

Subject to the approval of the application to the Population Office, Jersey Harbours will undertake a recruitment process internal and external to the island in order that a suitably qualified, experienced and skilled person can be appointed.
