Budget transfer to the Treasury and Resources Department for the Architects' Software budget

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister agreed to approve the following non-contentious transfer:

  of £10,400 from the Transport and Technical Services Department to the Treasury and Resources Department for the purpose of funding the costs of the Architects software.

Reason(s) for decision:

To ensure the software budget for the Architects is administered by the appropriate department.

Action required:

The Finance Director:

  to notify the Minister for the Treasury and Resources Department of the Minister’s approval to transfer the sum of £10,400 from the Transport and Technical Department to the Treasury and Resources Department for the purpose of funding the costs of the Architects software; and

  to notify the Treasurer of the States of the above decision to approve the transfer from the Transport and Technical Services Department to the Treasury and Resources Department for the purpose outlined in the attached report.

TRANSPORT AND TECHNICAL SERVICES

TRANSFER TO THE TREASURY AND RESOURCES DEPARTMENT FOR THE ARCHITECTS SOFTWARE BUDGET

Purpose of the Report

The purpose of this report is to seek the Minister’s approval of the recurring budget transfer to the Treasury and Resources Department of £10,400 for the funding of the Architects Software.

Background

As at the 1st January 2006 the Architects transferred from Transport and Technical Services to Jersey Property Holdings. However the software budget for the Architects is still maintained by Transport and Technical Services ISD section.

Discussion

The Transport and Technical Services ISD section administer and maintain the software budget for Transport and Technical Services. The demand on this section is ever increasing with the transfer into the department of the Blue Light Workshop, and Harbours etc.

There is no logic behind Transport and Technical Services administering the software budget on behalf of the Architects who have now transferred to Jersey Property Holdings.

Recommendations

It is recommended that the Minister:

(i) approves the non-contentious recurring transfer of £10,400 from the Transport and Technical Services Department to the Treasury and Resources Department for the purpose of funding the costs of the Architects software;

(ii) notifies the Minister of the Treasury and Resources Department of his approval of the recurring transfer of £10,400 for the purpose of funding the costs of the Architects software; and

(iii) notifies the Treasurer of the States of the transfer.
