Le Squez 58 - 68, and Garages - Demolition: Scheme Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO THE HOUSING MINISTER

APPROVAL OF SCHEME FOR

THE DEMOLITION OF 58 - 68 LE SQUEZ & 17 SINGLE CAR GARAGES

 

Background

 

On 19th March 2004 the States approved P19.2004 proposals for the regeneration of the Le Marais and Le Squez housing estates by demolition and rebuilding and or significant refurbishment, accepting that the funding for the works projected at some £50m overall would primarily come from the sale of homes developed on the sites.  Both estates would then be developed on a mixed tenure basis.

 

The regeneration of Le Marais is complete and the first two phases of Le Squez, Phase 1a and Phase 1b have been complete for some time and Phase 2a & 2b are currently in construction.

 

Demolition Works

 

The Minister will recall that on 6th April 2009 the Le Squez Master plan was approved, MD-H-2009-0030 refers.  A copy of the master Plan site drawing is attached for information at annex a hereto.  Phase 3 of the delivery of that Master Plan, which has been developed in consultation with the Education Department and other stakeholders, deals with the area of the site between the Marks & Spencer store and Samares Primary School and is shown on drawing 405C/07/02 Rev A, attached at annex b hereto.  The proposed works in phase 3 will involve the demolition of 10 bungalows numbered 58 to 68 School Road, and 17 single car Garages. Planning permission for the demolition of these units has already been obtained.

 

Once demolished, this part of the site will ultimately enable a land swap with the Education Department which will facilitate other aspects of the master plan such as the creation of the school square and the creation of a pedestrian link to F B Fields.  In the interim the area of land once cleared may be used to generate income from parking.

 

Recommendation

 

That the Minister:

 

  • Approve the proposals for the demolition of 58 – 68 Le Squez and the 17 single car garages as set out in the attached site Plan

 

  • Request that the Minister for Treasury & Resources accept his recommendations in accordance with States Standing Order 168(2).
