Funding for Women's Refuge (P.124/2014): Comments of Minister for Health and Social Services

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   P124/2014 Funding for Women’s Refuge: Comment from Minister of Health and Social Services

Decision(s): The Minister approved for presentation to the States Assembly her Comment on Proposition P:124/2014 Funding for Women’s Refuge

Reason(s) for Decision:  The Deputy for St Martin has submitted a proposition to the Treasury Minister seeking to increase the value of an existing service level agreement between Health and Social Services and Jersey Women’s Refuge, by reinstating funding for 2014-2015 to levels that were in place in 2013. The reduction in funding for the existing SLA, negotiated during 2013 and signed by all parties in 2014, was to support the funding of an agreed business case to establish a Multi-Agency Risk Assessment Group to tackle growing concerns about domestic violence in Jersey, under which some of the services formerly delivered by the JWR were transferred. The transfer of funding to Home Affairs supported the creation of an IDVA role to take on the responsibilities that the JWR declined to retain through revision of the terms of the then current SLA. 

 

Resource Implications: £ 70,000 (£20,000 in 2014 and £50,000 in 2015)

 

Action required: The Greffier of the States to be requested to arrange to present to the States Assembly the Comment of the Minister of Health and Social Services on Proposition P:124/2014 Funding for Women’s Refuge
