Springfield Primary School - Approval of drawings and acceptance of tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Springfield Primary School - Approval of Drawings and Acceptance of Tender

Decision(s): 

1.     In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved the drawings numbered 2462:101, 2462:102, 2462:103, 2462:104, 2462:105, 2462:106, 2462:107, 2462:108, 2462:109, all showing the proposed works to Springfield Primary School

 

2.     Agrees in accordance with Article 25 of the States of Jersey Law 2005 to accept the lowest fixed price tender submitted by Ray Wilkinson Builders Limited in the sum £343,232.18 to undertake the works at Springfield Primary School and enter in to a formal JCT Building Contract with Ray Wilkinson Builders Limited .

Reason(s) for Decision:

The drawings noted in item (1) above reflect the use for which the allocated back log maintenance funding has been granted.

Under Standing Order 168 (1d), it is a requirement for the Treasury Minister to approve of plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

The estimated total cost for the works at Springfield Primary School (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget. 

The lowest fix price tender submitted by Ray Wilkinson Builders Limited in the sum £343,232.18 can be accepted and a contract entered into.

Resource Implications: 

Other than those noted in the report, there are no further financial or manpower implications.

Action required: 

The Assistant Minister for T&R to approve of drawings noted in items 1 and 2 above. 

The Assistant Minister for T&R accepts the lowest fix price tender submitted by Ray Wilkinson Limited in the sum £343,232.18. 

The Assistant Director to sign the contract and any other associated documentation.
