Building Bye-Laws (Jersey) 2007 (as amended) Schedule 2, Part 3: Approval of New Technical Guidance

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Publication of revised technical guidance in support of the Part 3 requirements of Schedule 2 to the Building bye-laws (Jersey) 2007.

 

1.     Purpose of the Report.

To inform the Minister of comments received in response to published notices outlining proposed changes to the Part 3 requirements of the building bye-laws. It proposes in light of the favourable comments received, that revised technical guidance as detailed in the document entitled Technical Guidance Document Part 3 (2011 Edition) is now published.

 

  1. Main Changes in the 2011 Edition.

The guidance has generally been updated to reflect changes to British Standards. Guidance has been included in support of the new bye-law requirement 3.2A ‘Warning of release of carbon monoxide’ on the provision of carbon monoxide alarms where solid fuel, oil and gas fired appliances are installed in dwellings. The guidance on protection for buried oil tanks and fuel lines has been expanded. 

 

  1. Responses to the public notices inviting comments on the proposed changes.

 Two public notices have been published in accordance with the Planning and  Building (Building Bye-laws) (Jersey) order 2007. A summary of the comments               received in response to those notices is given in Appendix 1 to this report. All               comments are supportive of the proposed changes.

 

  1. Recommendation

 The Minister as empowered under Article 32 of the Planning and Building (Jersey)               Law 2002, publishes the revised Technical Guidance Document Part 3 -                             (2011 Edition) for the purposes of providing guidance on meeting the requirements               in Part 3 of the second schedule to the building bye-laws (Jersey) 2007, as               amended.
