Cadet and Military Support Officer: Budget Transfer

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved a budget transfer of £26,000 in 2013 and a recurring budget transfer in 2014 and 2015 of £42,000 from the Central Contingency (one-off) to the Lieutenant Governor’s Office revenue head of expenditure to fund the role of Cadet and Military Support Officer.

Reason(s) for Decision:  Article 17 (2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure to heads of expenditure of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

Resource Implications: Central Contingency (one-off) to decrease by £26,000 in 2013 and by £42,000 in 2014 and 2015 and the Lieutenant Governor’s Office revenue head of expenditure to increase by an identical amount in the respective years.  This decision does not change the total amount of expenditure approved by the States. Should there be a wish to extend this post beyond the end of 2015, a further application will need to be made to secure funding in future MTFP’s.

Action required: Business Manager to inform the Financial Performance and the Finance and Investment Manager that this decision has been approved.

Budget Transfers in 2013, 2014 and 2015 from Central CONTINGENCY to the Lieutenant Governor’s Office for Cadet and Military Support Officer

 

  1. Purpose of Report

 

To enable the Minister for Treasury and Resources to approve a budget transfer in 2013 of £26,000 and a recurring budget transfer in 2014 and 2015 of £42,000 from Central Contingency (one-off) to the Lieutenant Governor’s Office revenue head of expenditure to fund the role of Cadet and Military Support Officer.

 

  1. Background

 

Prior to the debate on the Medium Term Financial Plan in November 2012, an amendment (P.69/2012 Amd.3) was lodged which proposed to increase States total expenditure limits in relation to additional funding to re-instate the post of Island Military Liaison Officer (IMLO) in the Home Affairs Department.  

 

The Island Military Liaison Officer (IMLO) post was relinquished by Home Affairs as a 2012 CSR saving releasing 1.0FTE and £39,000.  The Home Affairs Department have since put in alternative arrangements for some of these functions and do not require an IMLO.  The Council of Ministers did, however, identify that it would be beneficial to create a Cadet and Military Support Officer to provide overarching coordination and support of Cadet Forces. This is different to the previous IMLO role.

 

The Council of Ministers proposed alternative funding measures for this proposal and subsequently the amendment was withdrawn.  CoM gave an undertaking that 2012 underspends would be earmarked to be carried forward to provide annual contributions of £42,000 to the new post of Cadet and Military Support Officer within the Lieutenant Governor’s staff for each of the years 2013 to 2015. This post was taken on 3rd June 2013 and is expected to be a contract to the end of 2015. Should an extension be needed, the Lieutenant Governors Office would need to apply for more funding in future MTFP’s.

 

4. Recommendation

 

The Minister is recommended to approve a budget transfer of £26,000 for 2013 and a recurring budget transfer in 2014 and 2015 of £42,000 from Central Contingency (one-off) to the Lieutenant Governor’s Office revenue head of expenditure.

 

5. Reason for Decision
