Community Provisions (Restrictive Measures - Syria) (Amendment No. 6) (Jersey) Order 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Deputy Chief Minister, in pursuance of Article 2 of the European Communities Legislation (Implementation) (Jersey) Law 1996 and having regard to Council Regulation (EU) No. 442/2011of 9 May 2011 concerning restrictive measures in view of the situation in Syria, decided to make the Community Provisions (Restrictive Measures - Syria) (Amendment No.6) (Jersey) Order 2011.

Reason(s) for Decision:  

The Community Provisions (Restrictive Measures - Syria) (Jersey) Order 2011 provides for restrictive measures in respect of Syria to include a ban on the supply of equipment which might be used for internal repression and the freezing of funds and economic resources of certain persons responsible for the violent repression against the civilian population in Syria. 

On 23 September 2011, Council Regulation (EU) No 950/2011 amended the original EU Regulation 442/2011 –

  • to add to the list of persons and entities which are subject to restrictive measures;
  • to introduce a prohibition on the supply of new Syrian banknotes or coins; and
  • to impose a prohibition on loans to, acquisitions of and joint ventures with a Syrian person or body engaged in the exploration, production or refining of crude oil.

In line with Jersey’s policy to implement equivalent measures, the Jersey legislation should be amended accordingly.

Resource Implications:  There are no manpower or resource implications arising from this Order.

 

Action required:  

The Deputy Chief Minister should sign and seal the attached Community Provisions (Restrictive Measures - Syria) (Amendment No.6) (Jersey) Order 2011. 

The Chief Minister’s Department shall –

(1) inform the Assistant Greffier of the States and the States Greffe Publications Editor immediately the Order is made.

(2) deliver the signed and sealed order to the Publications Editor.
