Budget Transfer - Jubilee Wharf.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Purpose of Report
  2. The Minister is asked to approve the necessary budget transfers to create a new capital Head of Expenditure to progress accommodation works at Jubilee Wharf.
  3. Background
  4. The States, at their meeting of 20 April 2005, agreed the Economic Development Department’s (EDD) Economic Growth Plan (P38/2005).
  5. The Plan agreed, amongst other things, ‘to put in place an expanded support service for small business development’ and charged ‘...the Finance and Economics Committee, in consultation with the Economic Development Committee, to assess the most appropriate source of funding.’
  6. An Economic Growth Plan fund has been established which currently contains an unallocated budget of £1,292,401.
  7. Of this sum, EDD has earmarked £361,000 to undertake accommodation works at Jubilee Wharf to progress the proposed business support service by creating a ground floor customer contact centre and co-locating relevant EDD staff.
  8. As the proposed work involves considerable alteration to a States building, Property Holdings should be the Project Sponsor. The Minister for Economic Development is asked to transfer £361,000 to a new capital Head of Expenditure in the Treasury and Resources (Property Holdings) range.
  9. In drawing up the proposals for the accommodation works, it became apparent that the earmarked sum of £361,000 is likely to be insufficient.
  10. Property Holdings has agreed to manage the works and, subject to Ministerial approval, provide additional funding of up to £200,000 from the Strategic Property Reserve (FXA031) to complete the accommodation works.
  11. In accordance with Financial Direction 3.6, paragraph 5.9, and on the basis that States approval to the principle has already been obtained in P38/2005 – The Economic Growth Plan, the approval of the T&R Minister will be required to create a new capital Head of Expenditure in the Treasury and Resources (Property Holdings) range and to agree the necessary budget transfers.

  12. Works are scheduled to commence immediately with completion due in January 2008. Any underspend against the overall budget of £561,000 will be returned to the Strategic Property Reserve.
  13. Currently the Housing Department are the ‘head tenant’ for Jubilee Wharf and have a full maintaining and repairing obligation. It is proposed that from January 2008, Property Holdings take on maintenance and repair obligations and common costs, to be recovered through a service charge mechanism, and that Economic Development becomes the ‘head tenant’.
  14. A rental of £25 per square foot is proposed from January 2008, an uplift from the rental of £23.09 per square foot that would have been charged should the existing arrangements have continued. This uplift reflects a review to a market rental position.
  15. All tenant departments have agreed to the proposed rent/service charge costs and that these will be contained within agreed 2008 revenue budgets. Any revenue budget transfers required between departments will be the subject of a subsequent approval process.

  2. To progress the business support service as prescribed in the Economic Growth Plan (P38/2005) approved by the States on 20 April 2005 by co-locating certain functions of the Economic Development Department in Jubilee Wharf.
