Delegated Authority Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Delegated Authority Decisions for Noting by Minister

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period from 31 August 2007 to 14 September 2007.

The Flower Shop, The General Hospital - Renewal of Lease between Miss Kay Smith and the Public of the Island. Commencing rental shall be £11,500 existing rental shall be £11,385.96 per annum.

Southern Warehouse, La Collette - Renewal of sub-lease between Channel Islands Welding Limited and Precision Plastics (Jersey) Limited for a term of 30 years.

Channel Islands Welding Limited, Southern Warehouse, La Collette - Assignment of Existing Sub-lease between Channel Islands Welding Limited and CIT Estates Limited to B G Romeril and Company Limited.

St Catherine’s Pier, St Martin - Site Licence Agreement : The Public and Jersey Airtel Limited.

Premier Contracting & Shopfitting Ltd - Renewal of lease for container site F25, La Collette, St Helier, for use as a storage container site, for a period of one year from 1 August 2007 at an annual rental of £1,356.80. All other terms and conditions as per the existing agreement save as to the inclusion of a 3 month break option in favour of the Lessor, approved by the Harbours & Airport Committee on the 27 August 1998.

Reason(s) for Decision:

To note the officer decisions in respect of the renewal of lease, renewal of sub-lease and assignment of existing sub-lease as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.

Resource Implications: There are no resource implications other than those set out in the decisions.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
