Money Laundering and Weapons Development (Directions) (Iran) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Money Laundering and Weapons Development (Directions) (Iran) (Jersey) Order 2015

Decision(s):  The Minister for External Relations made the Money Laundering and Weapons Development (Directions) (Iran) (Jersey) Order 2015. 

Reason(s) for Decision: 

The proposed Order re-enacts provisions originally made in 2012 under the Money Laundering and Weapons Development (Directions) (Jersey) Law 2012.  The Law provides for the giving of directions in response to threats to the interests of Jersey relating to money laundering, terrorist financing or weapons development and for incidental purposes.

The original Order expired in January 2013, in accordance with Article 7 of the Law, and was re-enacted twice for a further 12 months each time.  The current provisions cease to have effect on 14 January 2015, and the proposed Order will re-enact the provisions for a further year from that date.

The purpose of the Order is to give a direction to all financial services business based in Jersey or registered in Jersey, to prohibit them from entering into or continuing in any transaction or business relationship with any financial institution incorporated in Iran, or its branches anywhere, or the Central Bank of Iran. 

The Order would be made (a) on the advice of the Financial Action Task Force that measures should be taken in relation to Iran because of the risk of money laundering and (b) because the Minister believes that activity in Iran facilitating the development or production of nuclear weapons poses a significant risk to the interests of Jersey.

Resource Implications: 

There are no financial or manpower implications arising from the Proposition.

Action required:

External Relations shall forward the signed and sealed Money Laundering and Weapons Development (Directions) (Iran) (Jersey) Order 2015 to the States Greffe, requesting the Greffier of the States to arrange for the making of the Order to be notified to the States.
