Budget transfer from Restructuring Provision to Health and Social Services: Review of System Wide Governance

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Non-recurring budget transfer in 2016 from the Restructuring Provision to the Health and Social Services Department (HSSD) revenue head of expenditure in respect of a Review of System Wide Governance.

Decision(s):

The Minister approved a non-recurring budget transfer in 2016 of £100,000 to the HSSD revenue head of expenditure from the Restructuring Provision.

Reason(s) for Decision:   

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The aim of the project is to bring forward a Business Case for the Organisational Reform of Health and Social Services, which captures the need for new and inclusive Governance.

 

Funding was approved by the Council of Ministers on 20th April 2016.

 

A decision was signed by the Minister for Health and Social Services (MD- HSS-2016-0052) on 21st October 2016. 

 

Resource Implications:

The Restructuring Provision to decrease by £100,000 in 2016 and the Health and Social Services Department revenue head of expenditure to increase by an identical amount.  This decision does not result in any overall increase or decrease in the net expenditure of the States of Jersey, as approved in the MTFP 2016-2019.

 

Action required:

Head of Decision Support to advise the Management Accountant – HSSD once this decision has been approved.
