Jersey Council for Safety and Health at Work: Members: Re-Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Jersey Council for Safety and Health at Work: Members: Re-Appointment

Re-appointment of members to the Jersey Council for Safety and Health at Work

1.  SUMMARY

The constitution of the Jersey Council for Safety and Health at Work, which was agreed by the States on the 30th July 1991, provides for the appointment of members to the Council by the Social Security Committee.  With the introduction of Ministerial Government, the responsibility for appointment of members now rests with the Minister for Social Security.

The Minister is, therefore, requested to re-appoint persons put forward by the Chairman of Council, Mr P Richardson, to serve a three year term of office as members of the Council.

2. BACKGROUND

2.1 The Jersey Council for Safety and Health at Work

The Council is an independent body set up by the States, to promote the health and safety of workers and others affected by work activities.  The Council consists of a Chairman and four members who are appointed to serve a three year term of office.  The Minister presents a report to the States notifying of his intention to appoint the Chairman, with the Minister appointing members to the Council.

The Council also employs a part time Secretary/Treasurer.

The Council receives an annual grant to carry out its work and is required to submit an annual report and audited accounts to the States.

2.2 Re-appointment of two members

The terms of office of two members of Council, Mr Mike Osborne and Mr Russell Ball, expire on the 30th June 2014.  Mr Osborne has served two three year terms of office and Mr Ball a three year term of office.

Appointments to the Council are subject to the Jersey Appointments Commission Code of Practice for Appointments to Autonomous and Quasi-Autonomous Public Bodies and Tribunals, with the Council being considered to be a lower tier body.  The Code recommends that the term of office of a member should not exceed 10 years, with appointees to a lower tier body being eligible to serve any number of terms of office subject to the 10 year rule, providing their performance has been assessed as satisfactory.  Under the terms of the Code both Mr Osborne and Mr Ball are therefore eligible to serve a further term of office.

Mr Richardson, Chairman of Council, has recommended that both Mr Osborne and Mr Ball be re-appointed for a further three year term of office. Mr Osborne is currently employed as Managing Director of Ronez Ltd. and Mr Ball employed as a Senior Project and Cost Manager for Rowney Sharman (Jersey) Ltd.

A copy of the letter from Mr Richardson together with copies of C/V’s for Mr Osborne and Mr Ball are attached to this report.

2.3 Financial and manpower implications

Members of Council serve on an honorary basis and therefore these appointments have no implications for the financial or manpower resources of the States.

3. RECOMMENDATION

It is recommended that the Minister agrees to the proposal by Mr Richardson, Chairman of the Jersey Council for Safety and Health at Work, to re-appoint Mr Osborne and Mr Ball to serve on Council with effect from the 1st July 2014.
