Exercise Referral Scheme - 2009 Funding

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to the transfer of the 2009 funding for the Exercise Referral Scheme from Health and Social Services to Education, Sport and Culture.

Reason(s) for Decision:

Exercise Referral Practitioners are now permanent employees of ESC.  Therefore the existing contract funding for the staff costs held by H&SS should be transferred to ESC.

Resource Implications:

This decision is to transfer £77,250 from H&SS to ESC for 2009 only.   All future costs and income of the scheme will be accounted for by ESC and H&SS will no longer require any financial resource to support the scheme. 

Recurrent funding has been adjusted in the approved 2010 Business Plan opening cash limits of both departments. 

The appropriate manpower headcount has also been transferred to ESC.

Action required:

Instruct the Treasurer of the States to action this transfer as a non contentious transfer between departments.

Background

The exercise referral scheme in Jersey plays a key role in ensuring that all islanders who have a chronic condition, regardless of their economic and socio-demographic situation, have equitable access to a physical activity programme which will facilitate the self management of their condition. This will mean using a referral programme that supports them to make a behaviour change in their lifestyle or referral though a clinical pathway.

The Exercise Referral Scheme represents successful partnership working in several ways. Since its inception in 1995, the programme has been managed and funded conjointly by Health and Social Services and Education, Sport and Culture. Both departments are committed to the continuing provision which forms a core part of both departments’ agenda on getting people active.

The ongoing development of the programme would be supported by the existing joint management team of both the Senior Exercise Referral Practitioner their line manger and in addition the Head of Health Improvement and the Health Promotion Officer - Physical Activity

The practitioners are currently employed on service level contracts and are not entitled to the benefits received by permanent States of Jersey employees.  The management team are required to comply with the Employment Law (2003) and have to offer permanent civil service contracts to all of the employees of the scheme from January 2009.  The management team are fully supportive of these changes as it will offer sustainability to the programme and will ensure fair employment and recruitment to future posts in accordance with States of Jersey Human Resources policy. 

The most immediate outcome of adhering to the employment law is increased salary costs for the exercise referral practitioners. The scheme has a shortfall based on the difference in staff costs that needs to be met in order to keep the programme running in 2009, this has been funded by Health & Social Services.

Financial Implications

The previous employment contracts were funded by Health & Social Services and part recharged to Education, Sport & Culture until April 2009 when the Exercise Referral Practitioners were issued contracts of employment within Education, Sport & Culture.  Employment costs were then incurred by Education Sport & Culture and this report proposes to transfer the remaining £77,250 funding from H&SS to ESC for the remaining months of 2009. 

The recurrent effects are dealt with in the 2010 Business Plan.
