Public Sector Reform: Allocation from Restructuring Provision for Review of Sport and Culture delivery within Economic Development, Tourism, Sport and Culture Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Allocation of £181,500 from the Restructuring Provision to the Economic Development, Tourism, Sport and Culture Department for Public Sector Reform activity.

Decision(s): The Minister approved the 2016 allocation of up to £110,250, £41,250 in 2017, £7,500 in 2018 and £22,500 in 2019 from the Restructuring Provision to the Economic Development, Tourism, Sport and Culture Department for Public Sector Reform activity.  

Reason(s) for Decision:   

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The Contingency Allocation Policy published by the Minister for Treasury and Resources (R.10/2012) states that all requests for Allocation from Contingency will be considered by the Council of Ministers.

 

The Council of Ministers agreed on 23rd June 2016 to funding of £181,500 from the Restructuring Provision for Public Sector Reform activity within the Economic Development, Tourism, Sport and Culture Department. Funding of up to £110,250 in 2016, £41,250 in 2017, £7,500 in 2018 and £22,500 in 2019.

The Council of Ministers has acknowledged that investment will be needed to ensure Public Sector Reform is successful. Furthermore, funds have been identified and approved in the Medium Term Financial Plan and the Council of Ministers approved these requests at its meeting.

This decision will enable an evaluation of options for future service delivery of Sport and Culture over the next three and half years.

 

Resource Implications: The Economic Development, Tourism, Sport and Culture Department’s revenue head of expenditure will increase by up to £110,250 in 2016, £41,250 in 2017, £7,500 in 2018 and £22,500 in 2019 and the Restructuring Provision element of Contingency will decrease by the same amount.

This decision does not change the total amount of expenditure approved by the States for 2016 in the Medium Term Financial Plan.

Action required: Head of Decision Support to advise the Head of Finance, Economic Development, Tourism, Sport and Culture Department once this decision has been approved.
