Proposed sale of 2, 3, 37, 77, 39, 15, 17 & 38 Oak Tree Gardens, St Helier.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. 2 Ash Court, Oak Tree Gardens, La Route de la Trinite, St Helier, JE2 4ZU, with a first time buyer value of £340,000 to Miss Nadeen Lowe & Mr Christopher Gerald Winkworth for the sum of £255,000.

 

  1. 3 Ash Court, Oak Tree Gardens, La Route de la Trinite, St Helier, JE2 4ZU, with a first time buyer value of £345,000 to Mr Nicholas D’Orleans & Mrs Helen D’Orleans (née Snelling) for the sum of £258,750.

 

  1. 37 Vine Court, Oak Tree Gardens, La Route de Trinite, St Helier, JE2 4YQ, with a first time buyer value of £335,000 to Mr Jose Correia & Mrs Kerri Correia (née Speed) for the sum of £271, 350.

 

  1. 77 Elm Court, Oak Tree Gardens, La Route de la Trinite, St Helier, JE2 3EL, with a first time buyer value of £345,000 to Mr Ian Pryor & Mrs Kathryn Pryor (née Lang) for the sum of £258,750.

2. The Minister for Treasury and Resources authorises the Gift, Cession and Transfer of the Communal Areas by the Public to the “Oak Tree Gardens Property Owners Association” prior to the sale of the individual properties. 

All as previously approved by the States in Housing Property Plan (P6.2007).

Reason(s) for Decision: 

1.  Under Standing Order 168 (1) (a) and 168 (2) (a) and (b) the Minister accepts the recommendation of a body established by the States to manage land and buildings owned by the Public of Jersey in respect of the disposal of land.  

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Resource Implications: 

The Housing Department will receive a capital receipt as identified above, whilst foregoing a rental in respect of the above properties.

Action required: 

1.  The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Chief Executive of the Housing Department, the Minister, Treasurer and Deputy Treasurer.
