A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Social Housing Property Plan 2007 – 2016 (P.6/2007): Sale of 71 Grasett Park, St Saviour JE2 7XD

Decision(s):

The Minister;

 

1. Approved the sale of 71 Grasett Park with a First Time Buyer value of £345,000 to the purchasers set out in the attached report for the sum of £265,956.

 

The transaction being subject to a deferred payment condition as set out in the individual contract of sale.  The property shall also be subject to conditions which will require that any onward sale is to a bone fide first time buyer and that only one unit of accommodation shall be maintained on the site.

All areas of land to be included in the proposed transaction are marked on the attached site plan for this Estate. 

 

In respect of this transaction, ownership of the roads, footpaths, drains, street lighting, landscaped areas and other communal areas of the estate have been transferred to the “Grasett Park Property Owners Association”.  This will be reflected in the contract of sale in the agreed manner. The constitution for the Association, registered in the Royal Court on 15 August 2008, details the arrangements for re-charging any costs associated with the communal areas.

 

2.  Requested that the Minister for Treasury & Resources similarly agree and authorise the Greffier of the States and Attorney General to pass the necessary contract of sale before the Royal Court;

 

  1.  Decided that, in accordance with the States approval of P.6/2007 the resultant capital receipt is to be credited to the Housing Department’s Capital Works Programme.

 

Reason(s) for Decision:

To ensure that the sale is carried out in accordance with Standing Order 168 and the States’ approval of P6/2007.

 

Resource Implications:

Financial: £265,956 receipt as agreed on States approval of P6/2007 to be credited to the Housing Department’s Capital Works Programme with a deferred payment totalling £79,044 to be recorded as a long term asset on the department’s balance sheet.

 

Action required:

Director of Strategic Development to arrange for the approval of the Minister for Treasury and Resources and to oversee the passing of the contract and receipt of funds.
