Scott Gibaut Homes Trust: Approval of Constitution

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

      To approve amendments to Clause 3(a) of the Scott Gibaut Homes Trust constitution.

Decision(s):

The Minister approved the amendment of Clause 3(a) of the Scott Gibaut Homes Trust constitution to allow units of accommodation at Clearview Place, St. Helier, to be occupied by a wider group of residents with disabilities, subject to the approval of the alteration by the Royal Court.

Reason(s) for Decision:

      The Minister must approve any changes made to the Scott Gibaut Homes Trust constitution, in accordance with Clause 10 of the said constitution.

REPORT TO THE HOUSING MINISTER  

Scott Gibaut Homes Trust – Changes to Constitution  

Background  

The Scott Gibaut Homes Trust was established in April 2005 with the support of the Ministers for Housing and Health. In May 2007 the States approved the sale of the freehold interest in the former school at Clearview Place, St Helier from the Public of the Island to the Scott Gibaut Homes Trust for the purpose of developing the site to provide an “Independent Assisted Living Housing Scheme”.  

The development was completed in 2009 and now offers 7 self-contained flats on two levels, to be occupied by brain injury survivors and sufferers of cerebral palsy. 

Present Situation  

The Trust was initially set up to provide accommodation for brain injury survivors and sufferers of cerebral palsy. However, in recent years a number of other developments have been built which has assisted in accommodating sufferers of such conditions and the Trust is now in a situation where 3 of the flats have become difficult to let given the restrictions of the current constitution. The Trust has been able to identify people with other disabilities, learning difficulties in particular, who would greatly benefit from being given the opportunity to move into these units. 

In order to offer the units to people who are not brain injury survivors or sufferers of cerebral palsy, the Scott Gibaut Homes Trust constitution requires alteration. Clause 3 (a) has therefore been altered to remove the restriction of allocation only to those sufferers of the above conditions to a wider group of residents with disabilities. Clause 10 of the constitution stipulates that any changes to the constitution will require the prior approval of the Minister for Housing. 

Recommendations  

That the Minister,  

1.  Approves the changes made to the Scott Gibaut Homes Trust constitution to allow them to more appropriately occupy the units at Clearview Place.
