Brookfield, La Rue D'Empierre, Trinity: Planning Application considered by Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  P/2010/1018. Brookfield, La Rue D'Empierre, Trinity. Construct extension to form self contained 2 bed, single storey dependency unit. REQUEST FOR RECONSIDERATION OF REFUSAL OF PLANNING PERMISSION.

 

Decision(s): To maintain refusal and to substitute the original Reason No 1 with the following Reason:

 

1. The proposed extension is excessive in scale and does not exhibit a standard of design that respects, conserves and contributes positively to the built context and, accordingly, fails to satisfy the provisions of Policy G3 of the Jersey Island Plan, 2002 and which also fails to satisfy the Minister's Design Principles as embodied in Supplementary Planning Guidance - Planning Advice Note 4, 2006.

Reason(s) for Decision:

 

The Minister for Planning and Environment became aware that Planning Applications Panel (PAP) may not have been fully constituted for consideration of the above application and resolved to reconsider the application. The Minister considered all the relevant information including the information presented to the Planning Applications Panel. 

 The Decision to refuse the application has been upheld having taken into account the relevant policies of the approved Island Plan, together with other relevant policies and all other materials considerations, including the consultations and representations received. However, the Minister considered that the proposal was not a significant departure from Policy C5 of the Island Plan but did consider that the scale and design of the proposed extension was not appropriate in the context.

Accordingly, the Minister deleted the Reason No. 1 of the original refusal and introduced an amended Reason as given above.
