Legislation Advisory Panel: Appointment of Chairman and Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

  1. The Chief Minister decided that Senator Sir P.M. Bailhache will be re-appointed as Chairman of the Legislation Advisory Panel;
  2. The Chief Minister, having consulted with the Chairman, agreed to appoint the following States members to the Legislation Advisory Panel:

-       Connétable of St Mary, Juliette Gallichan

-       Deputy of St Martin, Stephen George Luce

-       Deputy of St Ouen, Richard John Renouf

-       Deputy of St Saviour No.2, Louise Mary Catherine Doublet

The Legislation Advisory Panel was established in 2006 following the move to ministerial government and advises on a number of matters dealt with by the former Legislation Committee.  The Panel, whose membership is drawn from both executive and non-executive members, advises the Chief Minister on a range of legislative matters, including: courts and court procedures; divorce, separation and maintenance; probate, intestacy and wills and succession; laws relating to property; amendments to customary law; Jersey Law of Contract; and miscellaneous items of legislation which do not fall under the remit of other ministerial offices.  The Panel has a working relationship the Jersey Law Commission, which was established in 1996 in order to help identify aspects of Jersey law which it considered should be examined with a view to reform, including responsibility for receiving such reports of the Commission as might be published from time to time.

The Chief Minister is accountable for the work of the Panel, the recommendations of which are presented to the Chief Minister for approval prior to relevant matters being lodged ‘au Greffe’ for consideration by the States Assembly in due course.

RESOURCE IMPLICATIONS:  There are no resource implications.

ACTION REQUIRED:

  1. The Chief Minister will inform Senator Bailhache of his appointment as Chairman of the Legislation Advisory Panel;
  2. The Chief Minister will confirm his agreement to the appointment of members with the Chairman of the Legislation Advisory Panel.
