Paying over to Jersey Employment Trust monies to refurbish Oakfield

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (14.02.06) to commence the paying over to Jersey Employment Trust of monies to refurbish the Oakfield accommodation.

Decision(s): Commence the paying over to The Jersey Employment Trust of monies to refurbish the Oakfield accommodation.

Monies will be passed over as costs are incurred, up to the maximum budget allocated of £565,000.

Reason(s) for decision: The Employment and Social Security Committee approved the refurbishment of the Oakfield site for use by the Jersey Employment Trust for ‘training, development and associated work based activities’ for a client group as outlined in the Jersey Employment Trust Deeds. The extract from the Employment and Social Security minutes dated 26-5-05, approving this decision, is as follows –

“The Committee agreed that the existing building on the Highlands College campus be retained and redeveloped for the use of Oakfield Industries Ltd [a subsidiary of the Jersey Employment Trust] and directed the Controller of Employment and Social Security, in conjunction with the Property Services Department, to proceed with negotiations for a lease of those premises for a minimum term of 10 years, or longer if such an agreement could be negotiated, at a rent to be agreed. The Committee further authorised in principle the expenditure of up to £565,000…”

Negotiations over a lease have now been concluded and the lease is in place, for a period of 21 years (a period which aims to match the life of the investment) at a rent of £8,000 per annum.

The Jersey Employment Trust have been through the appropriate steps as set out within terms of the Financial Direction, ‘The Control of Capital Expenditure’, and documented the actions they have taken to meet the requirements of the direction. They are now at the stage of being ready to award contract and commence work.

Action required: The Minister to approve the commencement of paying over monies to The Jersey Employment Trust for the refurbishment of the Oakfield accommodation.
