Tourism Development Fund: Grant: West Park Marine Lake Trust: St. Helier Sea Restoration Project

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Tourism Development Fund – approval of £115,000 grant to the West Park Marine Lake Trust for the St Helier sea pool restoration project.

 

Decision(s):  The Minister, on the advice of the Tourism Development Fund Advisory Panel, approved the award of a grant, subject to contract and conditions, from the Tourism Development Fund of £115,000 to West Park Maine Lake Trust for the St Helier sea pool restoration project.

 

Reason(s) for Decision: The Tourism Development Fund Advisory Panel is comprised of members drawn from the private sector who are charged with making recommendations with regard to awarding grants from the Fund. Applications are taken in two funding rounds (Spring and Autumn) which are then considered by the Panel at a series of meetings. The TDF Advisory Panel considered the application at four of its meetings in November 2013 and recommended that £115,000 be granted to West Park Marine Lake Trust on the basis that specified conditions were met. These conditions included confirmation of the other sources of funding, assurances over the maintenance & operation of the facility and the longevity of these arrangements.

 

The Panel considers that the opportunity to regenerate this disused area into a public water sports facility, with the project overseen by a willing, experienced and well supported  group comprising the  Bosdet Foundation, the Parish of St Helier, the States of Jersey Development Company, will offer long term benefits to both the tourism industry in the Waterfront area of St Helier and to the local population.

 

The Panel recommends the project to the Minister, and seeks approval to proceed with the grant accordingly.

Resource Implications:

The grant is made from the Tourism Development Fund, which has sufficient resources to cover  the grant . There are no further manpower or resource implications.

 

Action required:  The Minister instructs the Executive Officer to issue the contract on the basis of any conditions stipulated by the Tourism Development Fund Advisory Panel and in accordance with the Financial Direction on Grants (5.5).
