Valuing the Heritage of the Channel Islands

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (26.11.2008) to note and authorise for publication the report Valuing the Heritage of the Channel Islands.

Decision(s):

The Minister for Planning and Environment:

1        Received and noted the report Valuing the Heritage of the Channel Islands and authorised its release for publication;

2        Noted the recommendations contained within the report and specifically;

a)      noted the carrying out of further work being undertaken by the Societe Jersiaise to explore the potential for a joint CI World Heritage Site bid based on the fortifications of the CI;

b)      endorsed the undertaking of a public opinion poll on the value of heritage in Jersey;

c)      endorsed the development, collation and publication of a series of heritage indicators, in partnership with Jersey Heritage, through the medium of a Heritage Counts type publication.

3        With regard to 2b) above, the Minister did not endorse the engagement of MORI to undertake a public opinion poll.

Reason(s) for Decision:

1.-2.     The content of the report and the recommendations and actions arising from it are consistent with and contribute to the Minister for Planning and Environment’s responsibilities related to the identification, designation and protection of the Island’s historic built environment.

3.         The Minister did not support the engagement of UK consultants and expenditure of funds to undertake this work.

There are no legal implications arising from the report or the recommendations or actions identified within it.

Action required:

Action Required

1.      Publish report Valuing the Heritage of the Channel Islands;

2.      In partnership with Jersey Heritage, and ESC explore the viability of undertaking a public opinion poll about the value of heritage in Jersey, using existing resources, possibly engaging the States Statistics Unit;

3.      Continue to develop, in partnership with Jersey Heritage, a series of heritage indicators for Jersey, leading to the publication of an annual report on the state of the historic built environment in Jersey.
