J category Licence granted for the post of Director of Business and Enterprise Development

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (20.03.2006) to endorse the proposal  for a "J" Category Licence to be granted for the post of Director of Business and Enterprise Development.

Decision(s):

The Minister for Economic Development endorses the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1979, Regulation 1(1((j) for the post of Director of Business and Enterprise Development on the basis of a permanent contract.

Reason(s) for decision:

· A local recruitment process has commenced however it is considered unlikely that this process will identify a suitably qualified and experienced locally qualified candidate.

· In view of the need to deliver key operational objectives by January 2007, and the high level of professional qualifications and competencies required to fulfil this new post, it would be more satisfactory for the Department to advertise simultaneously locally and in the U.K .

· The role of Director of Business and Enterprise Development is critical to the business of the Economic Development Department and the attainment of States Strategic objectives, and is therefore deemed to be ‘essential’ as defined under the housing regulations.

Action Required:

· The Chief Executive Officer makes an application to the Population Office for a permanent "J" category Licence to be granted for the post of Director of Business and Enterprise Development, under the auspices of the Housing (General Provisions) (Jersey) Regulations 1970, Regulation 1(1)j;

· Subject to the approval of the application to the Population Office, the Economic Development Department undertakes a recruitment campaign outside of the Island in order that a suitably qualified, experienced and skilled person can be appointed.

Report to the Economic Development Minister

Request for "J" Category Licence approval -

Director of Business and Enterprise Development.

1. Purpose of the Report

1.1 The Minister is asked to support a request and recommend approval of a "J" category licence for the new post of Director of Business and Enterprise Development.

2. Background and Discussion

2.1 The Department currently has a vacancy for the post of Director of Business and Enterprise Development, which is a permanently funded post. The job description has been evaluated at Grade 14.

2.2 This is a one of the highest profile posts within Economic Development. The post holder will shape the future direction and image of the Economic Development Department with the business community on the Island, across the States of Jersey and its public and private sector partners. As such its importance cannot be underestimated.

2.3 The person specification for the post requires a high level of professional qualifications, together with broad experience. The Chief Executive Officer anticipates that the likelihood of attracting a candidate with the appropriate skills and breadth of experience to fulfil this crucial role from within Jersey is remote.

2.4 In view of the need to deliver key operational objectives by January 2007. It would be more satisfactory for the Department to advertise simultaneously locally and in the U.K, and if appropriate hold interviews for both locally qualified, and non locally qualified applicants at the same time. The “J” category licence would only be used in the event that recruitment from within the island was unsuccessful.

3. Recommendation

3.1 The Minister for Economic Development is asked to endorse the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1979, Regulation 1(1((j) for the post of Director of Business and Enterprise Development on the basis of a permanent contract.
