Planning and Environment fee charges 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Increase to Planning and Environment Department fees and charges in 2010.

The Minister decided to increase charges made under the:

  • Animal Welfare (Licence Fee) (Jersey) Order 2008
  • Dangerous Wild Animals (Jersey) Law 1999
  • High Hedges (Application Fee) (Jersey) Order 2008
  • Waste Management (Fees) (Jersey) Order 2008.
  • Planning and Building (Fees) (Jersey) Order 2008

Reason(s) for Decision:

To increase fee income from applications in accordance with: 

  1. The 2010 States business plan (for fees associated with Planning and Building (Fees) (Jersey) Order 2008 and High Hedges (Application Fee) (Jersey) Order 2008);
  2. 2.5% cost of living uplift as agreed by the Treasury (for fees associated with Animal Welfare (Licence Fee) (Jersey) Order 2008; Dangerous Wild Animals (Jersey) Law 1999;  Waste Management (Fees) (Jersey) Order 2008)

PROPOSED FEE INCREASES FOR PLANNING AND BUILDING APPLICATIONS.

Introduction.

The Department’s 2010 business plan sets a target of increasing total fee income from planning and building applications in 2010 by 15% and 5% respectively. Following the recent approval of the business plan by the States a review of the charges made for planning and building applications has been undertaken. This report sets out the level of charges for planning and building applications needed to achieve the business plan target.  

Fees for Planning Applications.  

The proposed charges for planning applications are set out in Appendix 1 to this report. This shows the level of fees to be charged in 2010 for each category of application.  

Fees for Building Applications .        

The proposed charges for building applications are set out in Appendix 2 to this report. This shows the level of fees to be charged in 2010 for each category of application.  
 

Recommendation.  

The Minister approves the proposed fee increases as set out in the appendices to this report.
