Disposal of Aquila Youth Club site

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Disposal Of Aquila Youth Club Site For Social Housing.

Decision(s):

The Minister supported the recommendation of Jersey Property Holdings to sell the former Aquila Youth Club site to the Les Vaux Housing Trust for the nominal sum of £10 for the development of 26 one bedroomed flats for social rented accommodation.

The Minister authorised the release of the necessary funding from the Housing Development Fund to fund capital and interest subsidies associated with the development.

The Minister authorised the Treasurer of the States to receive any subsequent agreed sum on completion of the project and credit that sum to the Housing Development Fund.

Under Standing Order 168 (1) (a) and 168 (3) the Treasury and Resources Minister hereby notifies the States that he has accepted the recommendation of Property Holdings to agree to the above land transaction.

Reason(s) for decision:

The proposal is consistent with the States ongoing policy to facilitate the development of social rented housing in conjunction with Housing Trusts, through the provision of capital and interest subsidy where required.

The scheme is considered to provide good value for money and meets the priority housing requirements identified in the revised Planning for Homes report (RC63/2005).

It is estimated that the net capital subsidy and ongoing interest subsidy costs can be contained within the Housing Development Fund.

Action required:

Head of Corporate Capital to report decision to the Housing Department, States Greffe and Chairman of the Les Vaux Housing Trust.
