Employment Tribunal Members - Draft an Order to increase rates of remuneration.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Employment Tribunal Members – Draft an Order to increase rates of remuneration.

Decision(s): The Minister decided that an Order should be prepared under the Employment (Jersey) Law 2003 to increase the daily sitting rate for the Chairman, Deputy Chair and Side Members of the Employment Tribunal, effective from 1 September 2008.

Reason(s) for Decision: The current rates of remuneration for the Tribunal members were set by amending the Employment Tribunal (Jersey) Regulations 2005 to provide the following rates from 1 November 2006; £736 for the Chairman, £552 for the Deputy Chairman and £97 for Side Members.   

The Employment Law was amended in 2007 to allow the Social Security Minister to make Orders setting the daily sitting rates for the Chairman, Deputy Chair and Side Members of the Employment Tribunal.  

The Chairman’s rate will be increased by Order in line with the current daily sitting rate for Commissioners of the Royal Court, resulting in a daily sitting rate of £774.  The equivalent percentage increase (5.1630%) will be applied to the Deputy Chairman’s rate resulting in a daily sitting rate of £580.50 and for the Side Members a new daily rate of £102.01.

Resource Implications: The increase will result in an additional cost of approximately £500 for the remainder of 2008.  The funds are available in the existing employment relations budget.

Action required: Ask the Law Draftsman to prepare an Order increasing the rates.
