Shooting Clubs: Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

In accordance with Article 15 of the Firearms (Jersey) Law 2000, the Assistant Minister for Home Affairs granted approval to the following shooting clubs:

 

-          St. Mary’s Rifle Club;

-          St Helier Miniature Rifle Club;

-          Eastern Air Rifle Club;

-          Vintage Arms Association;

-          Regent Shooting Club;

-          Jersey Outdoor Small-Bore Rifle Club;

-          Western Miniature Rifle Club.

 

In accordance with Article 15(2) of the Law, the Clubs listed above have submitted applications for approval as a shooting club, as set out in Schedule 8 to the Firearms (General Provisions) (Jersey) Order 2011.

 

The Applications have been reviewed by the Department for Community and Constitutional Affairs, and the States of Jersey Police, both of whom are satisfied that the Club adhere to the conditions to be met for approval as a shooting club (as agreed by the Firearms Liaison Group). The relevant Officer of each Club has been provided with a copy of these conditions. The Clubs are required to maintain their adherence to these conditions throughout the six year period of approval and are subject to further inspections by the States of Jersey Police for the duration of the approval.

 

In accordance with Article 15(3) of the Law, the Assistant Minister has consulted the Comité des Connétables on the applications. The Clubs have paid the relevant fee.

 

RESOURCE IMPLICATIONS:

There are no resource implications arising from this Ministerial Decision

 

ACTION REQUIRED:

The Policy Officer will notify the relevant Officer of each Club and request that a certificate be issued to each Club, valid for a period of 6 years from the date of issue.
