Delegated Authority Decisions for the period 6th March to 16th April, 2008

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period from 6 March 2008 to 16 April 2008.

 

Gunsite Café - Beaumont Sea Wall, St Peter - Lease assignment from David Cullen and Jane Cullen née De la Haye to Simon Critchley and Jacqueline Yvonne Critchley née Middlemass for the remaining term of the 9 year lease at a passing rental of £10,428.10 p.a.

 

B5 Quennevais Park, St Brelade - Sale of Unexpired Portion of Lease by Mrs Natasha Margarita Brennan née McNulty to Mr Michael Hayton Walsh and Mrs Patricia Mary Walsh née Quaid.

 

18 Maison d’Azette, La Grande Route de la Côte, St Clement - Gift, Cession and Transfer of Unexpired Portion of Lease by Mrs Sheila Victoria May Rice née Jesty to Mr Gordon de Ste Croix, Mr Danny de Ste Croix, Mrs Tina Sewrey née Rice and Mrs Linda May Houzé née Rice.

 

Unit Nos 103 - 107 Central Market, St Helier - Lease assignment - from FCBC Ltd T/A La Mangeoire to Ker Francois Ltd T/A Le P’tit Francois for the remaining term of the 0 year lease which commenced on 9 April 2005.  The passing rental is £18,612.59 per annum.

 

Old Blacksmith’s Shop, Corbiere, St Brelade - Lease assignment from Mrs Susan Le Marquand the Executor of Mr Robert Le Marquand deceased, to Mr Stephen Le Marquand for the remaining term of the 9 year lease which commenced on 24 June 2000.  The passing rental is £787.27 pa without further review.

 

 

 

No 74 Colomberie, St Helier - Lease assignment from J & M Removals Limited to Mr Ralph Graham Jackson for the remaining term of the nine year lease, which commenced on 1 May 2004. The assignment is deemed to be effective from the date agreed between the parties. The passing rental of £9,945.71 per annum is due for review on the 1 May 2010, with all other terms and conditions remaining the same.

 

Reason(s) for Decision:

 

To note the officer decisions in respect of the lease assignments, sale of unexpired portion of lease and gift, cession and transfer of unexpired portion of lease as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006. 

 

Resource Implications:  There are no resource implications other than those set out in the decisions.

 

Action required:

 

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
