Supplementary Planning Guidance: Design guidance for St. Helier - Consultation Draft

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment;

  1. noted and endorsed the annotated Urban character area design guidance for St Helier (WMUD: 2005), attached at appendix 1, as a basis for the preparation of draft supplementary planning guidance for public consultation;
  2. authorised officers to review and revise the Urban character area design guidance for St Helier (WMUD: 2005) to, for example, remove proposed Conservation Areas, which were the subject of separate workstreams, to ensure that the consultation draft of the SPG is up-to-date;
  3. noted and endorsed the draft design guidance for Esplanade, attached at appendix 2, as a basis for the preparation of draft supplementary planning guidance for public consultation and;
  4. authorised officers to develop this work with, for example the addition of graphics generally, to enable it to be integrated with the St Helier UCA work and issued as a draft for consultation, but specifically, to provide a graphical interpretation of how the design guidance might be interpreted along the frontages of the Esplanade character areas;
  5. noted and endorsed the additional guidance set out for the interpretation of Policy BE5: Tall buildings, at appendix 3, based upon the use of design guidance to assess the appropriateness of the proposed development of tall buildings, as a draft for consultation
  6. noted and endorsed the approach to consultation as set out in the report and at appendix 4.

Reason(s) for Decision:

  1. The preparation and adoption of design guidance for urban character areas in St Helier, including more detailed design guidance for Esplanade, will assist with the assessment of planning applications and contribute to an improvement in design, of benefit to the maintenance and enhancement of the character of the town in accord with Proposal 16 of the 2011 Island Plan
  2. The provision of additional guidance will assist in the interpretation, application and use of Policy BE5: Tall buildings.

Legal and Resource Implications:

Article 6 of the Planning and Building (Jersey) Law 2002, provides the Minister with power to issue guidelines and policies, and the development and publication of supplementary planning guidance accords with this.

The adoption of the guidance itself should assist the Department of the Environment and decision-makers by providing a greater certainty for developers, enabling efforts to be focussed on key issues.

Action required:

  1. Review the design guidance for each of the character areas, where applicable, to ensure that it is appropriate to issue as a draft for consultation;
  2. Refine and supplement the content of the draft design guidance for Esplanade, to enable it to be published as a draft for consultation;
  3. On the basis of 1 and 2 above, publish the revised urban character area design guidance as a draft for consultation, and engage with stakeholders, as appropriate, to facilitate consultation responses;
  4. Collate and analyse responses to consultation with a view to bringing the matter back to the Minister in due course for his further consideration and determination as soon as possible.
