Principal Historic Buildings Adviser

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made 24 March 2006, to secure necessary approval under Housing Regulations for the appointment of Principal Historic Buildings Adviser (Contract Post - term delegated to the Director, and Assistant Direct of Planning and Building Services).

Decision(s):

· The Minister for Planning and Environment endorses the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1970, Regulation 1(1)(J) for the post of Principal Historic Buildings Adviser on the basis of a temporary contract.

· The Minister delegated the determination of the contract term to the Director and Assistant Director of Planning and Building Services

Reason(s) for decision:

  A local recruitment process has demonstrated that there is not a local candidate that is presently able to fulfil the requirements of this post;

  The role of Principal Historic Buildings Adviser is critical to the business of the Planning and Environment Department and the attainment of States strategic objectives and is thus deemed to be ‘essential’, as defined under the housing regulations;

  The Historic Buildings Section of Planning and Environment is critically under-resourced;

  Determination of the contract period is management issue to be determined by the Director/ Assistant Director.

Action required:

  The Assistant Director of Planning and Building Services makes an application to the Population Office in the Chief Minister’s Department for a temporary contract for the post of Principal Historic Buildings Adviser under the auspices of the Housing (General Provisions)(Jersey) Regulations 1970, Regulation 1(1)(J) subject to the determination of the term of the contract by the Director/ Assistant Director;

  Subject to the approval of the application to the Population Office that Planning and Environment Department Human Resources undertake a recruitment campaign outside the Island in order that a suitably qualified, experienced and skilled person can be appointed
