Misuse of Drugs (Jersey) Law 1978: Authorisation of Superintendent Pharmacists to witness the destruction of controlled drugs

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Authorisation of Superintendent Pharmacists to witness the destruction of controlled drugs.

 

 

  1. Issue

 

The Minister is requested to consider authorising Superintendent Pharmacists as “authorised persons” under the provisions of the Misuse of Drugs (Jersey) Law 1978 for the purposes of witnessing the destruction of controlled drugs.

 

 

  1. Introduction

 

The Misuse of Drugs Advisory Council (MDAC) is established in accordance with Article 2 of the Misuse of Drugs (Jersey) Law 1978 and has a duty to advise the Minister on measures, which in its opinion, should be taken to prevent the misuse of drugs and/or to deal with the social problems connected with drug abuse.

 

 

  1. Background

 

The MDAC has given consideration to a proposal that Superintendent Pharmacists be authorised to witness the destruction of controlled drugs. Currently it is only the Chief Pharmacist who is so authorised.

 

In the case of a pharmacy business which is operated by a corporate body, (as opposed to one carried on by an individual pharmacist), that company must ensure that all dealings in medicinal products are undertaken under the direction and management of a Superintendent Pharmacist, who has legal and professional responsibilities for the conduct of the business

 

The recommendation of the MDAC is that it would be reasonable for Superintendent Pharmacist to be able to witness the destruction of controlled drugs when carried out by another pharmacist in one of their registered pharmacy premises. It is a legal requirement to keep a record of any such destruction.

 

 

  1. Recommendation

 

The Minister is recommended to authorise all Superintendent Pharmacists as an “authorised person” for the purposes of Article 31 of the Misuse of Drugs (General Provisions) (Jersey) Order 2009 and direct the Chief Pharmacist to notify Superintendent Pharmacists accordingly.
