Criminal Injuries Compensation Board: Members: Re-Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Criminal Injuries Compensation Board – re-appointment of two lay members.

 

Decision(s): The Minister decided to re-appoint Dr. G. Llewellin for a further period of up to 4 years from 1 May 2014 and to re-appoint Mr. M.A. Payne for a further period of 12 months.  The Minister also decided to request the HR Manager to run a recruitment campaign for legally qualified and lay members of the Criminal Injuries Compensation Board (CICB) in time to replace those members whose terms of office expire on 30 April 2015 and who will have served in excess of 10 years at that point in time.

Reason(s) for Decision: The terms of office of Dr Llewellin and Mr Payne as lay members of the CICB are due to expire on 30 April 2014.  Both wish to remain in post and the Chairman is happy for them to stay on.  Dr Llewellin has already served for 6 years and Mr Payne for 13 years.  Rather than run a recruitment campaign at this juncture, it was felt preferable to wait until next year when several other members’ terms of office will expire.  The Appointments Commission have indicated that they are happy for Mr Payne to continue to serve although he has exceeded 10 years in post, which is the maximum that they normally suggest.

Resource Implications: Nil.

Action required: The Executive Officer, Home Affairs, to notify the Secretary to the CICB of the re-appointments and the HR Manager to organise a recruitment campaign in late 2014 or early 2015 for the CICB.
