Budget transfer from Restructuring Provision for the review of options for future of Sport and Culture delivery

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Public Sector Reform – Allocation of £181,500 from the Restructuring Provision for the review of options for the future of Sport and Culture delivery.

Decision(s):

The Minister approved the 2016 allocation of £181,500 from the Restructuring Provision to the Economic Development, Tourism, Sport and Culture.

Reason(s) for Decision:

As part of the measures adopted by the States to balance the Consolidated Fund by 2019, all departments have been asked to identify savings over the next three years. The Economic Development, Tourism, Sport and Culture Department’s savings allocation of £2,500,000 for 2017-2019 will be delivered through a combination of efficiencies across all service areas and where appropriate a fundamental change in the way services are delivered. Sport and Culture are areas where significant savings could potentially be made and funding of work to evaluate options for future service delivery changes is required over the next three and half years, in order to capture such savings.

 

The Council of Ministers agreed, on 23rd June 2016, to the funding of £181,500 from the Restructuring Provision for the Review of future Sport and Culture delivery. Funding of up to £110,250 was approved for 2016, £41,250 in 2017, £7,500 in 2018 and £22,500 in 2019.

The States recognised the need to invest funds to achieve success in the Public Sector Reform (PSR) Programme when it approved a Restructuring Provision in the Medium Term Financial Plan. This decision will enable a comprehensive review of Sport and Culture delivery to be carried out over the next three and half years.

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure or the insurance fund of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

Resource Implications:

The Restructuring Provision will decrease by up to £110,250 in 2016, £41,250 in 2017, £7,500 in 2018 and £22,500 in 2019 and the Economic Development, Tourism, Sport and Culture Department’s budget will increase by an identical amount. 

This decision does not change the total amount of expenditure approved by the States for 2016 and the Medium Term Financial Plan.

Action required:

The Minister for Economic Development, Tourism, Sport and Culture to seek approval of the Minister for Treasury and Resources for the transfer.
