Government Headquarters, Union Street, St. Helier: Acquisition: Commercial Terms of Arrangement/Lease

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: New Government Headquarters (office) Union Street St Helier, Jersey, JE2 3DN – Proposed acquisition - agreeing to commercial terms of arrangement/lease in accordance with the Budget 25-28 (Minister for Social Security)

 

Report Title: New Government Headquarters (office) Union Street St Helier, Jersey, JE2 3DN – Proposed acquisition - agreeing to commercial terms of arrangement/lease in accordance with the Budget 25-28

Exempt (Article 33(b))

Decision(s):

​​Following the agreement of:  -​the Minister for Infrastructure to initiate the process of acquiring the building; and  -the Minister for Treasury and Resources to exercise the Option to acquire the new Government Headquarters in line with the pre-agreed terms by using money from the Social Security (Reserve) Fund; and subsequently put into place optimal and legally binding arrangements for the new Government Headquarters to be held as a local infrastructure investment for the Social Security (Reserve) Fund; and  -​put into place an arrangement whereby the Social Security (Reserve) Fund, will receive internal budget reallocations, which would mirror future lease arrangements.  This decision represents the agreement of the Minister to commercial terms, in accordance with P.51/2024 'Approved Budget 2025-28', by way of entering into a Memorandum of Agreement with the other Ministers referred to above, which deals with the financial and administrative arrangements for the new Government Headquarters, and includes a Draft Form of Lease between the Social Security (Reserve) Fund and the Public of the Island, which will be the form or substantially the form of a future lease in respect of the Union Street Offices.

Reason for Decision(s):

​​As part of P.51/2024, the States Assembly approved the leasing of the Union Street Offices (new Government Headquarters) by the Public of the Island from the Social Security (Reserve) Fund, with commercial terms to be agreed between the Minister for Infrastructure (on behalf of the Public), the Minister for Social Security and the Minister for Treasury and Resource (both on behalf of the Fund).

Resource Implications: ​​Funding is included within the approved Budget (Government Plan) 2025-2028 and will be included for future proposed Budgets. There are no additional specific staffing implications.​

 

Action Required: The Department and/or Ministerial Office to update relevant parties of the decision.
